In the Will of Annie Constance Sterry late of 15 Rushall Crescent North Fitzroy, Spinster
Dated 8 Nov 1907

This is the last Will and Testament of me Annie Constance Sterry of No 15 Rushall Crescent North Fitzroy in the State of Victoria Spinster I appoint my mother Mary Sterry of No 15 Rushall Crescent widow my sole executrix to this my Will. I devise and bequeath to my mother all my real and personal estate whatsoever and wheresoever situate. Signed & acknowledged by the said Annie Constance Sterry as and for her last Will and Testament in the presence of us present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses – Annie C Sterry, W Taylor Stone, 64 Delbridge St North Fitzroy, E E Stone 64 Delbridge St N Fitzroy, dated 11 Jul 1905

Papers of Administration

I William Ely Sterry of 58 Alford Street Prahran in the State of Victoria Accountant make oath and say
1. That I am seeking to obtain administration of the estate of the above named Annie Constance Sterry deceased with the will of the above named deceased annexed and I am of the full age of twenty one years
2. The said deceased died on the twenty third day of August 1907
3. The said deceased was unmarried at the time of her death
4. The said deceased left a Will bearing date 11 July 1905 which is as I believe the last Will and Testament of the said deceased and which is unrevoked.
5. That the testatrix was of the full age of twenty one years at the date of the execution of the said Will
6. By her said Will the said testatrix appointed Mary Sterry formerly of 15 Rushall Street North Fitzroy but late of 58 Alford St Prahran Widow deceased sole executrix thereof and the said Mary Sterry died on the twenty eighth day of September 1907 without having proved the said will
7. The paper writing herewith annexed marked “A” is the true last Will and Testament of the said Annie Constance Sterry as I verily believe
8. The said Will was executed in the presence of William Taylor Stone of 64 Delbridge St North Fitzroy gentleman and Elizabeth Eileen Stone of 64 Delbridge St North Fitzroy married woman
9. The said deceased left real estate in the State of Victoria not exceeding the value of six hundred and seventy three pounds three shillings and four pence and personal property in the said State not exceeding the value of fourteen pounds fifteen shillings and seven pence …
10. … I will well and truly collect and administer according to law … the property lands and hereditaments goods chattels and credits of the said deceased … I will make or cause to be made a true and perfect inventory of all and singular the property, lands etc … and will exhibit and deposit or cause to be exhibited the deposited the same inventory in the Master of Equity within three calendar months … I will make … a true and just account of the administration of the estate …
11. The father and mother of the said Annie Constance Sterry are dead and that I am a brother and one of the next of kin …

All that piece of land having a frontage of 34 feet 4 inches to Rushall Crescent by a depth of 122 feet to a 10 feet row at the rear on which are erected two brick cottages, 4 rooms each with kitchen, bathroom and scullery slate roof party wall one let to Dutton at 10/6 the other to Sykes at 12/6 per week. Cottages are old and in bad state of repair. Land described in Certificate of Title Vol 2966 Fol 593143 – Valuation by R. D. Hooper herewith £673 3s 4d

Upon application this day made by the Proctor for the applicant and upon reading the several affidavits of William Ely Sterry and the exhibits therein referenced to and of Frederick Elmore Watts respectively sworn and filed herein
This Court doth order that Letters of Administration with the Will which will was executed on the eleventh day of July 1905 annexed of the said Annie Constance Sterry be granted to William Ely Sterry of 58 Alford Street Prahran in the State of Victoria Accountant a brother and one of the next of kin of the said deceased Mary Sterry the executrix appointed by the said Will having died on the 28th September 1907, this court doth further order that the date at foot of the said will after the signatures be omitted from the copy will on Letters of Administration.

I certify that the sum of £22 18s 8d for Duty on these Letters of Administration has been paid. J F Poole Officer under Sec 96 of Act 1060.
